1. Agreement to These Terms

Please read these Terms of Service (“Terms”) carefully before using the Pray Hamilton website located at prayhamilton.ca (the “Site”), operated by Pray Hamilton (“we,” “our,” or “us”), a community prayer movement based in Hamilton, Ontario, Canada.

By visiting, accessing, or using our Site in any way, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Site. These Terms apply every time you visit or use the Site.

2. Privacy Policy

Your use of this Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We encourage you to read the Privacy Policy carefully before using our Site. If a dispute cannot be resolved informally, it shall be submitted to binding arbitration or adjudicated in a court of competent jurisdiction in the Province of Ontario, as determined by applicable law. You consent to the exclusive jurisdiction and venue of such proceedings.

The compilation of all content found on this Site is the exclusive property of Pray Hamilton. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any content from this Site without our prior written consent, except as permitted under the Copyright Act (Canada) or other applicable law.

6. Limited License to Access the Site

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and make personal, non-commercial use of this Site. This licence does not include the right to:

Download, copy, or modify any portion of the Site or its content for commercial use
Resell or commercially exploit any content, products, or services obtained through the Site
Use data mining, robots, scraping, or similar automated data extraction tools on the Site
Frame or mirror any portion of the Site without our express written consent

Any use of the Site beyond the scope of this limited licence, without our prior written consent, is strictly prohibited and will terminate this licence automatically.

We will not send you unsolicited commercial electronic messages. All email communications are subject to our compliance with CASL.

8. User-Submitted Content

Our Site may allow visitors to submit prayer requests, comments, or other content. By submitting content to our Site, you agree that all submitted content will:

Not be obscene, defamatory, threatening, or abusive
Not infringe any third party’s intellectual property rights or privacy
Not contain software viruses, malware, or any malicious code
Not constitute unsolicited commercial solicitation or political campaigning

We reserve the right (but not the obligation) to review, edit, or remove any user-submitted content at our sole discretion and without notice.

By submitting content to our Site, you grant Pray Hamilton a non-exclusive, royalty-free, perpetual, and worldwide licence to use, reproduce, publish, and display such content in connection with our ministry activities, in any media now known or later developed. You represent that you have the right to grant this licence.

Prayer requests and personal communications submitted to us are treated as confidential pastoral correspondence and will not be published or shared without your consent.

9. User Accounts

If you create an account on our Site, you are solely responsible for:

Maintaining the confidentiality of your login credentials (username and password)
All activity that occurs under your account
Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts, remove content, or restrict access at our sole discretion, including for violations of these Terms or conduct we determine to be harmful to our community or ministry.

10. Disclaimer of Warranties

Our Site and its content are provided on an “as is” and “as available” basis without any warranty of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We make no guarantee regarding the accuracy, completeness, or timeliness of any content on the Site.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Pray Hamilton shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, this Site or its content, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from your use of the Site shall not exceed the amount, if any, that you have paid to us in the twelve months preceding the claim.
